Our Data Processing Agreement (DPA)
How your daycare agrees to NestliCare's Data Processing Agreement, where to read it, and how to get a copy.
The Data Processing Agreement (DPA) is the contract that covers how NestliCare handles your families', children's and staff's information on your behalf. Your daycare decides what the records are for; NestliCare stores and processes them only to run the service for you.

How your daycare agrees to it
The DPA forms part of our Terms of Service. When you create your daycare's account, the signup screen says you agree to our Terms, Privacy Policy and Data Processing Agreement, with a link to each. There is no separate form to sign.
This works the same way in every country, including the EU, the UK, Switzerland and South Africa. Those laws require the agreement to be in writing, and an electronic agreement counts.
What we record
For daycares that sign up from September 29, 2026, we record when the account was created with that agreement, which user created it, the IP address it came from, and which versions of the Terms and DPA were live at the time.
Some daycares accepted the DPA on a separate screen in the dashboard before then. Those records are kept.
That screen still exists for a daycare that asked to accept the DPA explicitly. If your account is set up that way, an owner or admin sees a Data Processing Agreement screen before the dashboard opens, and accepts it there.

Read or print it any time at nestlicare.com/dpa. Your browser's print option can save it as a PDF.
When the DPA changes
If we make a material change, we email the owner and administrators of every daycare before the change takes effect. The page shows the date it was last updated.
Owners also see a We've updated our Terms message in the dashboard. It covers the Terms, Privacy Policy and DPA together, and lists what changed.
- Click I agree and the new version applies to your daycare straight away.
- Click Not now and you won't be asked again. The new version applies from the date shown, as long as you keep using NestliCare.
If you have concerns about a change, reply to the email before the date it takes effect.
Questions
Does every admin or teacher need to agree? No. The agreement is between your daycare and NestliCare, made when the account is created. When the terms change, one owner's answer covers the whole daycare.
Can we withdraw from it? The DPA applies for as long as you use NestliCare. To stop, download your data first under Settings → Privacy → Export all organization data (owners only), then close your account.
